1. About these terms

These terms apply to everyone who uses The Funky Art Teacher ("the platform"), operated by Mariaan Luyt. By creating an account, buying credits or starting a lesson you accept these terms. They are governed by the laws of the Republic of South Africa, including the Consumer Protection Act and the Electronic Communications and Transactions Act.

2. Your account

You must give accurate details and keep your password private. Accounts are personal and may not be shared. Learners under 18 should use the platform with the consent of a parent or guardian.

We may suspend accounts that misuse the platform, for example through scraping, automated requests or sharing lesson materials.

3. Copyright and lesson materials

All reference photographs, lesson pictures, step demonstrations, colour recipes, texts, guides and illustrations belong to Mariaan Luyt / The Funky Art Teacher and are protected by copyright.

When you unlock a lesson you receive a personal, non-commercial licence to view and download its materials, including the 300 DPI reference, for your own study and painting. You may not resell, share, publish, upload to other websites or use these materials to train other software.

Paintings you create by following a lesson are yours. You may display and sell your own painting, but please credit "Reference: The Funky Art Teacher" where the composition comes from a library picture.

4. Your uploads

You keep full ownership of the photos and paintings you upload. You give us a limited licence to store, process and display them only to deliver your lessons, Coach Mariaan reviews and your private Gallery.

Only upload images you have the right to use.

5. Credits, lessons and prices

Prices are set and charged in South African Rand (ZAR). Amounts shown in other currencies are approximate and for information only; your bank sets the final exchange rate and any fees.

Credits are digital goods delivered immediately. They do not expire, cannot be exchanged for cash and are not transferable. A library lesson or own-picture lesson is unlocked with credits or a once-off card payment as shown at checkout. Each lesson includes 3 comparisons in Stage 9; further comparisons and Coach Mariaan reviews cost credits as shown.

Because credits and lessons are delivered digitally and immediately, used credits and started lessons are not refundable, except where the law requires it. If you are charged incorrectly or something does not work, contact us and we will put it right.

6. Printing your reference

The downloadable reference is supplied at 300 DPI with its original proportions. Printers and print shops often scale, stretch, crop or change colours (for example with "Fit to page"). Print at "Actual size / 100%" and check the proportions before you start.

Mariaan Luyt and The Funky Art Teacher are not liable for distortion, stretching, scaling, cropping or colour differences caused by your printer, print shop, screen or software.

7. Coach Mariaan (AI)

Coach Mariaan is an AI-powered learning assistant based on Mariaan's teaching method. Its feedback, colour mixes and demonstration pictures are educational guidance, may contain mistakes, and are not a personal review by Mariaan nor a valuation of your artwork.

8. Limitation of liability

The platform is provided "as is". To the extent allowed by law, we are not liable for indirect loss, loss of materials, or results of your painting. Our total liability is limited to the amount you paid in the 12 months before the claim. Nothing in these terms limits your rights under the Consumer Protection Act.

9. Changes and contact

We may update these terms; the date above shows the latest version. Continued use after changes means you accept them.
